HCC members are reminded of either complying with or registering with the CalSavers retirement program. Employers with a qualified retirement program need to register with the program, and show they are excepted. Employers without a retirement program will need to enroll, when their employee counts mandate it. The deadline was September 30, 2020 for employers with more than 100 employees. The next deadline is June 30, 2021 for employers with more than 50 employees. The last deadline is June 30, 2022 for employers with 5 or more employees.

What to do if you receive a 1099 G form for someone you don’t recognize? As you are probably aware, the Federal Pandemic Unemployment Assistance (PUA) program provided benefits to self-employed persons, or independent contractors, who normally would not qualify for benefits. This program is rife with fraud, as EDD had no information from an employer to review. Some employers report receiving 1099 G forms, for parties they don’t know. The EDD would appreciate you forwarding the information to them, as they are trying now to pursue the many fraudulent filings.

U.S. Treasury and SBA Begin Next Phase of PPP Loans
 
The next phase of Paycheck Protection Program loans begins today, and continues until the money runs out or March 31, 2021.
 
HCC is still very concerned that there is no clarity given regarding the economic uncertainty of the borrower. The borrower must sign under criminal penalties for knowingly giving false information, that “Current economic uncertainty makes this loan request necessary to support the ongoing operations of the Applicant”. There was huge uncertainty in the Spring or 2020, and there is still uncertainty now. But the Treasury and SBA have not rescinded their loan necessity questionnaire when borrowers of $2 Million or more are requesting forgiveness. The Treasury and SBA have changed the rules after the fact on multiple occasions. HCC members will want to consult with their CPA or other advisors regarding the possibility of these new loans.
 
There are multiple forms now for those considering a first time PPP loan, or those looking for a second draw loan. All the forms can be accessed through the Treasury website by clicking here.
 
For those considering applying for a second loan, the requirements are that you can have no more than 300 employees, the loan can’t be for more than $2 Million, you have spent all the first PPP loan amounts on appropriate expenditures; and that at least one of your 2020 quarters had a 25% or greater reduction in gross receipts from the corresponding 2019 quarter.

  1. The Q & A document has been updated to show that the extension of payment due dates is now 10 months after either the loan forgiveness period or the date the SBA provides the forgiveness amount to the lender. It was previously 6 months. The Q & A confirms no change to the promissory notes need to be made. You can see the latest Q & A by clicking here.
  2. The U.S. Treasury has also provided new guidance on how changes of ownership affect existing PPP loans. You can read the guidance by clicking here. 
  3. Several news outlets have advised that the SBA is now processing the first group of loans to be forgiven under the PPP. We hope that more information on the process will be forthcoming.

To fight the underground economy, the Board is seeking to require three new license classes to mandate having WC by January 1, 2022. These classes are C-8 Concrete Contractors, C-20 HVAC Contractors, and D-49 Tree Service Contractors. Once approved by the Legislature, no contractors in those classes would be able to file an exemption for WC. These three would be in addition to the C-39 Roofing Contractors class. The future goal is to have the mandated WC requirement for all license classes by January 1, 2025. You can read more about this starting on page 89 of the Board Meeting Packet from September 9, 2020. The Actuarial Committee of the WCIRB met on September 8, 2020; and finalized their recommendations which were approved by the WCIRB Governing Committee on September 9, 2020. This regards the Advisory Rates for Workers' Compensation for policies renewing January 1, 2021, through August 31, 2021. As we have previously alerted, the WCIRB proposed three changes to workers' compensation insurance regulations. The pages reference the WCIRB regulatory proposal to the Commissioner, linked below.  

  1. Eliminating workers' compensation claims that arise directly from a COVID-19 diagnosis, from the employers future Experience Modification Calculations. You can see the final verbiage on page 14 of the document.
  2. Eliminating payroll used in workers' compensation premium calculations for employees who are being paid, either through the emergency Federal Paid Sick Leave, or Paid Family leave, or the employer keeping that employee on the payroll; but having no duties of any kind. You can see the final verbiage on page 8 of the document.
  3. Allowing an individual employee to be classified under Clerical Office Employees-8810; if they are temporarily working in conditions that qualify for that class code, and then move back to a previously assigned code. You can see the final verbiage on page 8 of the document.
