The current average claims cost benchmark rate was $1.46. The WCIRB Actuarial Committee proposed a $1.50 average, while the Public Actuary proposed a $1.34 average.</span></div><div><span style="font-size: 16px;">﻿</span></div><div><span style="font-size: 16px;">HCC Director of Risk Management testified at the public hearing, encouraging Commissioner Lara to go much closer to the Public Actuary number than the Actuarial Committee number. After his actuarial staff reviewed the information, the Commissioner ruled for a $1.41 average. While we would have liked a lower number, we appreciate the reduction in average rates.</span></div><div>&nbsp;</div><div><span style="font-size: 16px;">These are advisory rates only, each insurer will make their own decision about where to land on the average. Also, each WC classification will change based on that classification’s experience. The proposal will go to a public hearing before Insurance Commissioner Ricardo Lara.</span></div><div><span style="font-size: 16px;">There is a significant difference between the advisory rates proposed by the WCIRB Actuarial Committee, and the Actuary for the public members of the WCIRB Governing Committee. The Committee’s proposal was for a 2.7 % increase, while the Public Actuary’s numbers are in the range of a 9% decrease. HCC’s Director of Risk Management Bruce Wick typically testifies at the hearing, asking the Commissioner to use the Public Actuary’s proposal. It is unclear where Commissioner Lara will rule, based on the wide difference between the two proposals. <title>WC Advisory Rate For 2021 Issued, Resulting In A 4.6% Decrease</title>

<description><![CDATA[<div style="color: rgb(0, 0, 0); font-family: Verdana, Geneva, Arial, Helvetica, sans-serif; font-size: 14.6667px;">On Wednesday, November 25, 2020, Insurance Commissioner Lara issued his decision regarding the Workers' Compensation Advisory rates for policies with anniversary rating dates starting January 1, 2021.</div><p style="color: rgb(0, 0, 0); font-family: Verdana, Geneva, Arial, Helvetica, sans-serif; font-size: 14.6667px;">&nbsp;</p><div style="color: rgb(0, 0, 0); font-family: Verdana, Geneva, Arial, Helvetica, sans-serif; font-size: 14.6667px;">CALPASC Director of Risk Management Bruce Wick had testified during the public hearing on October 5, 2020; asking the Commissioner to use the rate proposal of the public actuary Mark Priven, instead of the WCIRB Actuarial Committee's proposal.</div><p style="color: rgb(0, 0, 0); font-family: Verdana, Geneva, Arial, Helvetica, sans-serif; font-size: 14.6667px;">&nbsp;</p><div style="color: rgb(0, 0, 0); font-family: Verdana, Geneva, Arial, Helvetica, sans-serif; font-size: 14.6667px;">The Commissioner did indeed use the public actuary's numbers, resulting in a decrease of 4.6% from the approved 2020 advisory rates. This is great news for employers.</div><div style="color: rgb(0, 0, 0); font-family: Verdana, Geneva, Arial, Helvetica, sans-serif; font-size: 14.6667px;"><span style="font-size: 11pt;">Commissioner Lara also denied the WCIRB Actuarial Committee's proposal to increase the advisory rates by 4% for COVID-19 claims, that had a system of 6 tiers of different rates, depending on the employer's industry.                             <li>The WC insurance market remains stable in California. Page 5 of the report.</li>
                            <li>The average charged rate in the beginning of 2020 is 8% below the average charged rate from 2019. Page 9 of the report.</li>
                            <li>Of the COVID-19 filed WC claims as of July 7, it is not surprising that Health Care and Social Services compromise 45% of those claims, while Government employees including Police and Firefighters comprise 17% of claims. Construction
                                workers are only 3% of all the COVID-19 claims. That is great work, and the industry should be commended. Page 17 of the report.</li>
                            <li>Permanent Disability claims in California are 250% higher than the national median. That is a major reason why California is one of the highest cost states in the nation. Page 33 of the report.</li>
                            <li>Late indemnity claims filed in California, more than 12 months after the alleged injury, are twice the national median. Page 49 of the report.</li>
                            <li>The ratio of Allocated Loss Adjustment Expense(ALAE) in California is also twice the national median. ALAE are costs allocated to a particular claim, such as attorney costs or subrosa investigations. Page 55 of the report.</li>
                            <li>The ratio of Unallocated Loss Adjustment Expense(ULAE) in California is also just short of twice the national median. ULAE are costs of the insurers own claims staff, or a Third Party Administrative staff. Page 57 of the report.</li>
                            <li>The frictional cost to deliver a benefit dollar in California is more than twice the national median. Page 58 of the report.</li>
                            <li>While combined loss and expense ratios are rising, they are still below 100%, which is still a profitable margin for insurers; with investment income added for profit. Page 65 of the report.</li>
                            <li>In 2018, California WC insurers had a 14.3% return on net worth. Page 67 of the report.</li>

<title>Updated Information On Workers&apos; Compensation</title>

<p style="margin-bottom: 7.5pt;"><span style="color: black;">Governor Newsom did not extend or renew his Executive Order on Workers' Compensation. That is good news. CALPASC members are reminded that even though the Order expired on July 5, 2020; they should be aware of the following:</span></p>
<ol>
    <li style="color: black;"><span>Employees who were working at the employer's jobsite, away from their residence; have 14 days after their last day of work at that site, to claim a rebuttable presumption of WC for contracting COVID-19. Employees can still make a claim if they are diagnosed through the 14 days. That would be up to July 19, if they worked as of July 5, 2020. </span></li>
    <li style="color: black;"><span>Thankfully, the number of rebuttable presumption claims filed under the Executive Order were not nearly as many as anticipated. Most of them were for first responders and front line healthcare workers. And, a substantial number of claims were denied for WC due to the employee testing negative for COVID-19. </span></li>
    <li style="color: black;"><span>CALPASC members should still be vigilant, in that claims can be filed even after July 19, 2020; for the rebuttable presumption; if the employee was diagnosed anytime during the Executive Order, March 19, 2020; through July 19, 2020; and the employee tested positive for COVID-19. Members would still need to respond to these later filed claims.</span></li>
    <li style="color: black;"><span>CALPASC members should remember to ensure their claims adjusters record any COVID-19 claims under the special category that removes that claim from the employers' future Experience Modification calculations. Some employees might have a claim now, medically recover, but later file that they suffered some long term damage internally. </span></li>
    <li style="color: black;"><span>Employees can still file a WC claim for COVID-19 for working at home or at the jobsite July 6, 2020 or after. They won't have the presumption; and the employer will have 90 days to deny the claim if the COVID-19 illness was not contracted at work. </span></li>
    <li style="color: black;"><span>There are still three active bills in the legislature, AB 196-Gonzalez-D, AB 664-Cooper-D, SB 1159-Hill-D, Daly-D. CALPASC and its contract lobbyist RJ Cervantes will be involved with these bills, to avoid any new presumption for COVID-19 for construction workers or workers related to supplying the construction industry.</span></li>

<div>The hearing was new Insurance Commissioner Ricardo Lara's first advisory rate hearing. It was held on October 14, 2019, in San Francisco. The WCIRB rate filing was for an overall 5.4% rate decrease from the 2019 advisory rates. The WCIRB also showed that the next quarter of results after their original filing indicated the decrease could be a total of 7.2%. The public actuary testimony showed a total&nbsp;<span>decrease</span>&nbsp;of 9.1%. Bruce testified to the Commissioner that the public actuary's proposed rates had been more predictive year after year, and he strongly urged a ruling on the full 9.1% reduction. Bruce also asked the Commissioner to review and process the ruling as soon as possible, so employers who renew in early 2020 would have time to thoroughly work out their renewal quotes.</div>

The WCIRB actuarial committee had proposed that the Advisory WC rate could be reduced by 3.7% for July 1, 2019. The public actuary, Mark Priven, had proposed an even lower number, 6.2%. The insurer members of the Governing Committee used their superior numbers to hold off any mid year filing. </div>

<div style="margin-bottom: 0.0001pt;">They cited concerns over Pharmaceutical cost reductions that can't be maintained, Medical Inflation, and continued high Loss Adjustment Expenses.The good news is that workers' compensation costs are continuing to decrease. </div>

<div style="margin-bottom: 0.0001pt;">Those whose renewals are mid year 2019, can have discussions with their brokers and advisers regarding the fact that costs are reducing in the range of 4% to 6% for 2019.</div>
